FAQ
Can I terminate a tenancy as a landlord without giving a reason?
Only in exceptional cases: if you live in a building containing no more than two flats, or let accommodation within your own flat (§ 573a BGB), with three months added to the notice period. Otherwise, you need a legitimate interest under § 573 BGB.
What notice period applies to landlords?
Three months for occupancy of up to five years, six months from five years and nine months from eight years (§ 573c Abs. 1 BGB). Under § 573a BGB, three months are added. The notice must be received by the third working day of the month.
Do I have to issue a formal warning before giving notice?
The law does not require a formal warning before termination with notice for a breach of obligations. However, for many breaches, whether the breach is considered significant depends on a warning having been given. If in doubt, issue a warning first and give notice if nothing changes.
Can I terminate a tenancy with notice because of rent arrears?
Yes. Arrears that are more than minor and for which the tenant is at fault constitute a breach of obligations under § 573 Abs. 2 Nr. 1 BGB. Once arrears reach two months' rent, termination without notice may also be possible; the two are usually combined.
How do I terminate a tenancy for personal use?
Use our termination for personal use template. It asks who needs the flat, checks the restriction period following conversion into individually owned flats and creates the letter with the notice period and information about the right to object.
Can I send the termination notice by email?
No. The notice must be in written form with a handwritten signature (§ 568 Abs. 1 BGB). Print the letter, have all landlords sign it and deliver it in a way that provides proof of receipt.
Will my details be stored or transmitted?
No. The letter is created entirely in your browser. The PDF and Word files are generated on your device; nothing is sent to us or to third parties.
